
What is a right-of-way plat?
A critical part of a roadway improvement project can be the establishing or expanding of road right-of way. Historically, lengthy strip descriptions or metes and bounds descriptions for the taking, exchanging or establishing of road right-of-way, but often times these types of descriptions are difficult to delineate out in the field. Under the current Minnesota Statutes Chapter 160.085 the state or a county can record a right-of-way plat, which creates parcels of land around new right-of-way, existing right-of-way or severed right-of-way parcels. In the majority of Minnesota municipalities, ordinances have been adopted that require subdivision plats and actually prohibit the use of strip descriptions or metes and bounds descriptions.
Benefits of right-of-way plats
For projects where plats are not possible, our survey staff in each office is experienced and qualified to write accurate metes and bounds descriptions. Often clients such as Public Utility Commissions or utility companies require this service.
