Wetland Services

Bolton & Menk is currently assists more than 20 municipalities as the Local Government Unit (LGU) agent administering the Minnesota Wetlands conservation act. As such, we inform the various review agencies of submittals, call Technical Evaluation Panel (TEP) meetings when necessary, and process decision notices for wetland delineations, encroachment wetland permit applications, and mitigation plans. We also review approved wetland mitigation areas to ensure replacement wetlands are functioning properly.

 

Where we do not act as the LGU agent and where we have no conflict of interest, we will work for clients needing wetland permitting assistance. In these cases, we provide wetland delineation services, prepare and submit delineation reports, prepare permit applications, design wetland mitigation sites, and annual monitor the mitigation sites in accordance with the Minnesota wetland conservation act. Having reviewed and administered a significant number of applications as an LGU agent gives us critical knowledge in the correct procedures and sequencing techniques needed for a successful permit application.

 

Bolton & Menk has experience in assisting clients in developing wetland banks that may be sold as acceptable mitigation for area wetland encroachments. This experience includes the design of successful wetlands, obtaining LGU and other agency approvals, providing annual monitoring of the banked wetland and assistance in getting the banked wetlands listed as being available on the Board of Water & Soil Resources (BWSR) website.
