ADA transition planning is a critical process for ensuring cities and public entities meet the accessibility standards outlined in Title II of the Americans with Disabilities Act (ADA). This process involves a self-evaluation of existing pedestrian infrastructure, policies, and practices, followed by the development of a transition plan to remove identified barriers. These plans are essential for improving pedestrian access routes (PAR) and pedestrian circulation routes (PCR), especially in the public right-of-way.
In Minnesota, ADA transition planning is not only a best practice—it’s a requirement. Under 28 CFR 35, local public agencies with 50 or more employees must develop a transition plan. The Minnesota Division of the Federal Highway Administration mandates that the Minnesota Department of Transportation (MnDOT) self-certify its planning processes and document ADA compliance for the 2021–2024 Statewide Transportation Improvement Program (STIP). MnDOT is actively surveying agencies to assess their ADA transition plan status and ensure ongoing integration of accessibility improvements into infrastructure programs.
In contrast, the Iowa Division of the Federal Highway Administration and the Iowa Department of Transportation have not pursued formalized enforcement of this regulation. However, public entities in Iowa are still required to complete the self-evaluation and transition planning process to comply with ADA Title II. The absence of enforcement does not eliminate the requirement or the liability that may arise from incidents caused by accessibility barriers. Entities must identify such locations and develop a plan for their removal to enhance safety and meet federal accessibility standards.
